International Environmental Regulation Trend

International environmental regulation refers to the legal and technical standards being tightened worldwide to reduce environmental impact. Four regimes are summarised below.

KOREA RoHS

Framework Act on Resources Circulation (ROK)

Enforcement Purpose
  • Controlling and reducing the environmental contamination caused by waste from electronic information products
  • Encouraging the manufacture and sale of low-pollution electronic information products
  • Achieving cleaner production and improving the efficiency of resource use
Target Items
  • 10 Electric and Electronic Product Items (TVs, refrigerators, washers (home), air conditioners, PCs, audios, mobile phone terminals, printers, copiers, and facsimiles), Cars and end-of-life cars
Regulated Items and Allowable Concentration
  • On the basis of weight by part and by substance
  • Pb, Hg, Cr6+, PBBs, PBDEs : 0.1 wt% · Cd : 0.01 wt%
Object in Duty Manufacturers, importers and recycling operators

Producer's Duties

  • Observing restrictions on hazardous substances and the required recyclability rates, using readily recyclable materials, and voluntarily testing, assessing and declaring hazardous-substance content
  • Reliably providing recycling operators with recycling information on product materials, hazardous substances and dismantling methods
  • Meeting obligations to collect and recycle at least a set proportion of the electrical and electronic products sold

Exception Provision

Exemptions may be designated by Presidential Decree where the case is equivalent to an EU RoHS exemption, where removal of the hazardous substance is not technically possible, where no substitute substance exists, or where the purpose is research and development or export.

CHINA RoHS

Enforcement Purpose
  • Controlling and reducing the environmental contamination caused by waste from electronic information products
  • Encouraging the manufacture and sale of low-pollution electronic information products
  • Achieving cleaner production and improving the efficiency of resource use
Target Items
  • Parts of the products produced, sold, and imported in China as electric and electronic information products such as TVs, computers, home appliances, electronic communication products, electronic gauges, electronic radars, electronic parts (1,400 or more items of 11 classifications)
Regulated Items and Allowable Concentration
  • Pb, Hg, Cr6+, PBBs, PBDEs : 0.1 wt% · Cd : 0.01 wt%
  • ※ However, lead, cadmium, mercury and Cr6+ in the case of metal plating materials

Producer's Duties

  • Attaching contamination control symbols and hazardous substance information labels
  • Indicating the environmental protection use deadline where the hazardous substance concentration standard is exceeded
  • Marking the material name for packaging materials
  • Not permitted to use a hazardous substance for a product on the main management list (※ pre-certification before sales: schedule and method undetermined)

CHINA RoHS

WEEE-aligned scope

Enforcement Purpose
  • Obliged to limit the use of hazardous substances in an electric or electronic product that deter recyclability or cause environmental contamination when the product is discarded or recycled, and to replace those substances with less harmful ones
Target Items
  • 8 item groups among the application items of WEEE (large home devices, small home devices, information communication equipment, consumer home appliances, lighting devices, electric and electronic tools, toy and leisure sports goods, and automatic selling machines)
  • Light bulbs and home lights
  • However, excluding the products sold in the market before July 1, 2006

Exception Provision

Exceptions apply to the small amount of mercury in a fluorescent lamp, the lead contained in the glass for a cathode ray tube and an electronic part, the lead used in small quantities for alloys, and the lead for soldering; battery guidelines apply for batteries.

California, USA RoHS

Enforcement Purpose
  • Controlling and reducing the environmental contamination caused by waste from electronic information products
  • Encouraging the manufacture and sale of low-pollution electronic information products
  • Achieving cleaner production and improving the efficiency of resource use
Target Items
  • Electronic devices corresponding to EU RoHS
Regulated Items and Allowable Concentration
  • Not permitted to sell electronic devices containing the six substances of RoHS

Exception Provision

Same as EU RoHS.

J-MOSS of Japan

Enforcement Purpose
  • Controlling and reducing the environmental contamination caused by waste from electronic information products
  • Encouraging the manufacture and sale of low-pollution electronic information products
  • Achieving cleaner production and improving the efficiency of resource use
Target Items
  • Seven items corresponding to the Act on Promoting the Effective Utilization of Resources (PCs, unit type air conditioners, TVs, microwave ovens, clothes dryers, electric refrigerators, electric washers, etc.)
Regulated Items and Allowable Concentration
  • A person manufacturing, importing or selling a target item is not permitted to use the six hazardous substances in that item from July 1, 2006.
  • Allowable Concentration: Pb, Hg, Cr6+, PBBs, PBDEs : 0.1 wt% · Cd : 0.01 wt%

Producer's Duties

The following information must be provided where the six hazardous substances are present at or above the standard values:

  • Indicating the inclusion marks (the orange R mark and the green mark) on the main body of a product and the packing box
  • Indicating the inclusion mark and the corresponding chemical substance symbol in the product catalog or the instruction manual
  • Providing the inclusion information of a hazardous substance on the website

Exception Provision

There is an additional item which is similar to EU but is not in EU RoHS.
